- Scope
These Terms of Use apply to the use of the New Ecumene platform.
The platform allows users to create user accounts, create profiles, publish content, and interact with content published by other users.
- Platform idea and Community Rules
New Ecumene is intended to be a space of voluntary creative cooperation.
The ethical foundation of the platform is based on the principles of Buddyalism. For the purposes of the platform, this means in particular respectful communication, protection of the dignity of others, non-violence, honesty, respect for personal boundaries, responsibility for one’s own content, and avoidance of intentional harm to other users.
Use of the platform does not require any personal religious, political, philosophical, or ideological commitment to Buddyalism. Users are not required to adopt Buddyalism as a personal belief. However, users must follow the rules of conduct that apply on the platform.
The Community Rules specify these rules of conduct and form part of these Terms of Use insofar as they describe permitted and prohibited behavior on the platform.
- User account
Certain functions require a user account.
When registering, you must provide accurate and current information. Access credentials must be kept secure and must not be shared with third parties.
Users are responsible for all activities carried out through their user account, insofar as they are responsible for them.
If you suspect that your user account has been misused, please inform us immediately at:
admin@newecumene.live
- Minimum age
Use of the platform is only permitted if you are at least 16 years old or if your legal guardians have given their consent.
- Permitted use
You agree to use the platform only lawfully, fairly, and respectfully.
In particular, the following are not permitted:
- illegal content;
- content that infringes third-party rights, in particular copyrights, trademarks, personality rights, or data protection rights;
- threats, calls for violence, targeted harassment, intimidation, or hate speech;
- defamatory, fraudulent, or misleading content;
- spam, phishing, malware, automated abuse, or other attacks on the platform;
- content that depicts, promotes, or trivializes sexual exploitation of minors;
- publication of personal data of other persons without a legal basis;
- circumvention of technical protection measures or manipulation of the platform;
- use of the platform for fraud, deception, unlawful advertising, or other unlawful purposes.
- Special platform rules of conduct
In addition to the general rules, the following principles apply.
a) Dreams and personal goals
Dreams, personal goals, and vulnerable self-expression of other users must be treated with special care.
In particular, targeted mockery, degradation, exposure, or aggressive unsolicited advice regarding another person’s dreams or personal goals is not permitted.
Constructive feedback is allowed when it takes place in an appropriate context and the affected person has expressly or clearly asked for feedback.
b) Projects, commerce, and spam
Commercial projects, entrepreneurship, and presenting one’s own work are generally allowed, provided they are honest, transparent, and respectful.
Aggressive advertising, mass messages, manipulative sales methods, misleading promises, fraud, spam, or using the platform merely as a sales channel without regard for the character of the community are not permitted.
c) Politics and enemy images
New Ecumene is not intended as a platform for political campaigns, party-political advertising, political mobilization, or escalation of current political conflicts.
We may restrict or remove content if its main purpose is party-political advertising, political mobilization, creation of enemy images, escalation of hatred, or transfer of current political conflicts onto the platform.
Discussions about history, culture, philosophy, ethics, society, personal experiences, future questions, and forms of human cooperation remain permitted, provided they are conducted respectfully and do not violate these Terms of Use.
d) Respectful communication
Disagreement, criticism, and discussion are allowed. However, insults, targeted humiliation, trolling, passive aggression, harassment, intimidation, or other behavior that turns another person into a target of attacks are not permitted.
e) Voluntary communication and friendship
No one is required to communicate with specific persons, become friends, provide help, or reply to messages.
Forcing communication after an express or clearly recognizable refusal, harassment, stalking, pressure, manipulation, or aggressive reactions to rejection are not permitted.
f) Protection of privacy
Publishing personal data, private messages, addresses, phone numbers, documents, or other confidential information of other persons without a legal basis or consent is prohibited.
Threatening to publish such information is also prohibited.
Serious violations of privacy protection may lead to immediate moderation measures, including permanent suspension or deletion of the user account.
- User content
You generally retain your rights to the content you publish on the platform.
However, by uploading or publishing content, you grant us a simple, worldwide, non-exclusive, and royalty-free right to use the content to the extent necessary to store, technically process, publicly display, reproduce, transmit, and make the content available as part of the platform functions.
This right of use serves solely to operate and provide the platform.
The right of use generally ends when content is deleted or the user account is deleted, unless legal obligations, security reasons, legitimate interests, technical limitations, backups, or already completed lawful uses prevent this.
You represent that you have all necessary rights to the content you publish and that such content does not violate applicable law, third-party rights, these Terms of Use, or the Community Rules.
- Public visibility of content
Published content may be publicly visible. Other persons may read, store, share, copy, quote, or find public content through search engines.
Please check before publishing whether the content should really appear publicly.
- Moderation
We may review, remove, restrict the visibility of content, or temporarily or permanently restrict, suspend, or delete user accounts if there are specific indications that content or use violates applicable law, third-party rights, these Terms of Use, or the Community Rules.
Moderation decisions may be based in particular on:
- reports from users or third parties;
- our own review;
- technical indications of spam, abuse, malware, or security risks;
- legal obligations or official orders;
- violations of the Community Rules.
Possible moderation measures include in particular:
- notice or warning;
- request to edit or remove content;
- reduced visibility of content;
- removal of content;
- temporary restriction of specific features;
- temporary suspension of the user account;
- permanent suspension or deletion of the user account in cases of serious or repeated violations.
When choosing a measure, we take into account, where appropriate, the severity of the violation, the context, possible repetition, impact on other users, platform safety, and the principle of proportionality.
We may use technical tools to detect spam, malware, security risks, or abusive use. Final decisions on permanent account suspensions are not made solely by automated means.
Where legally required, we will inform affected users about significant moderation decisions and the reasons for them.
- Reporting illegal content under the Digital Services Act
If you believe that illegal content is present on the platform, you can send us a notice at:
admin@newecumene.live
To allow us to review a notice, it should include the following information:
- a sufficiently substantiated explanation of why the reported content is considered illegal;
- the exact electronic location of the content, in particular the URL, and, where necessary, additional information enabling identification of the content;
- your name and email address, except where anonymous reporting is legally permitted;
- a statement confirming that you believe in good faith that the information and allegations are accurate and complete.
We will confirm receipt of the notice where electronic contact information is available and inform you of our decision where legally required.
- Complaint against moderation decisions
If you disagree with a moderation decision, you can contact us at:
admin@newecumene.live
Please provide your user account, the affected content, the moderation decision, and the reason for your complaint.
We review complaints carefully, without discrimination, without arbitrariness, and with regard to the circumstances of the individual case.
- Availability of the platform
We strive to operate the platform reliably. However, there is no entitlement to uninterrupted or constant availability.
The platform may be temporarily restricted or unavailable, in particular due to maintenance, updates, technical issues, security measures, or events beyond our control.
- Changes and termination of the user account
You may delete your user account at any time, where the platform provides such a function, or contact us to request deletion.
We may temporarily or permanently suspend, restrict, or terminate user accounts if there are serious or repeated violations of these Terms of Use, the Community Rules, applicable law, or third-party rights.
- Liability
We are fully liable in cases of intent and gross negligence.
In cases of simple negligence, we are liable only for breaches of essential contractual obligations whose fulfillment makes the proper use of the platform possible and on whose compliance users may regularly rely. In such cases, liability is limited to foreseeable, contract-typical damage.
Liability for damages resulting from injury to life, body, or health remains unaffected. Mandatory statutory liability also remains unaffected.
Users are generally responsible for the content they publish. We do not adopt third-party content as our own merely because it is stored or displayed on the platform.
Once we become aware of illegal content and removal or blocking is legally required, we will respond appropriately.
- Changes to these Terms of Use
We may amend these Terms of Use if this is necessary due to technical, legal, or organizational changes.
We will communicate significant changes in an appropriate manner. If you continue to use the platform after the changes take effect, the amended Terms of Use shall be deemed accepted to the extent permitted by law.
- Applicable law
German law applies, unless mandatory consumer protection provisions provide otherwise.
- Notice pursuant to § 36 VSBG
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
